Terms of Service

Effective Date: May 4, 2026

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Swingbase LLC ("SwingBase," "we," "us," or "our"). By creating an account, accessing, or using the SwingBase platform at swingbase.ai and related applications (the "Service"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

2. Eligibility

You must be at least 13 years old to use SwingBase. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service. By using SwingBase, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To use SwingBase, you must sign in using a Google account through our authentication provider (Clerk). You are responsible for maintaining the security of your Google account credentials. You must also choose a username during onboarding that complies with the following rules:

  • 3 to 20 characters in length
  • Lowercase letters, numbers, and underscores only
  • Cannot start or end with an underscore
  • Must not impersonate another person or entity

We reserve the right to reclaim or reassign usernames at our discretion, including usernames that are inactive, misleading, or infringing on trademarks.

You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. User Content

"User Content" includes scores, round posts, comments, reactions, profile information, swing videos you record with SwingTrace, and any other content you submit to SwingBase.

  • Ownership: You retain ownership of your User Content. By submitting content to SwingBase, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.
  • Swing videos: Videos recorded with SwingTrace are stored locally on your iPhone in the Photos library and are not uploaded to our servers. You control sharing of swing videos via the iOS share sheet or the in-app peer-to-peer request flow. See the Privacy Policy for what swing-related metadata is stored on our servers.
  • Recording others:When you use SwingTrace to record someone else's swing, you are responsible for ensuring you have their consent to do so. Do not record people who have not consented, and do not record in jurisdictions where recording is restricted by law.
  • ML improvement data:If you have left the opt-in "Help improve SwingTrace" toggle on, you grant us a perpetual, royalty-free license to use the per-frame ball-detection statistics and trace-quality feedback you submit to train, evaluate, and improve our ball-detection models. This data is described in detail in the Privacy Policy and contains no video frames, audio, or identifying information.
  • Accuracy: You are responsible for the accuracy of scores, handicaps, and other golf data you submit. Submitting intentionally false scores or manipulating data to gain an unfair advantage is prohibited.
  • AI processing: Certain features (tournament recaps, league summaries, caddie chat) use third-party AI services to generate content from your data. Before any data is transmitted to an AI provider, personal identifiers (names, email addresses, phone numbers) are automatically replaced with anonymous tokens so the provider never receives your real identity.   • Removal: We may remove User Content that violates these Terms or that we determine is harmful, inappropriate, or inaccurate at our sole discretion.

5. Acceptable Use

You agree not to:

  • Submit false, misleading, or fraudulent scores or handicap information
  • Harass, bully, threaten, or intimidate other users
  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to other accounts, the platform infrastructure, or related systems
  • Use automated scripts, bots, or scrapers to access or collect data from the Service without our written permission
  • Interfere with or disrupt the integrity or performance of the Service
  • Circumvent rate limits, security measures, or access controls
  • Create multiple accounts to evade bans, manipulate leaderboards, or abuse referral programs

6. Tournaments, Leagues, and Competitions

SwingBase enables organizations and users to create and manage golf tournaments, leagues, and competitions. By participating in these events:

  • You agree to abide by the rules set by the event organizer and any applicable golf governing body rules.
  • SwingBase is a platform provider and is not responsible for the conduct, organization, or outcomes of events created by third parties.
  • Event organizers are responsible for ensuring their events comply with applicable laws and regulations.

7. Payments and Refunds

Certain features of SwingBase may require payment, including tournament registration fees and premium subscriptions. All payments are processed securely through Stripe.

  • Registration fees: Fees for tournament registration are set by event organizers. SwingBase facilitates payment collection but is not the seller or organizer.
  • Refunds: Refund policies for tournament registrations are determined by the event organizer. Contact the organizer directly for refund requests. SwingBase is not responsible for issuing refunds on behalf of organizers.
  • Payouts: Referral commissions are processed through Stripe. Tournament purses and side-game winnings are settled by the event organizer or directly between participants, not by SwingBase. You are responsible for any taxes owed on amounts received.
  • Contests and side games: Optional games such as skins, closest-to-pin, and similar side games are games of skill organized by the event organizer or by participants among themselves. SwingBase provides scoring, tracking, and record-keeping only; it does not operate a wager, act as a stakeholder, hold pooled funds, or guarantee any prize.
  • Subscriptions: If you purchase a subscription, it will renew automatically at the end of each billing period unless you cancel before the renewal date.

8. Referral Program

SwingBase may offer a referral program that allows users to earn rewards for referring new users. By participating in the referral program:

  • You agree to share referral links honestly and not use misleading, spammy, or deceptive methods to generate referrals.
  • We reserve the right to void referral rewards, suspend accounts, or modify the referral program at any time if we detect fraud or abuse.
  • Referral rewards, commissions, and program terms are subject to change at our discretion.

9. Intellectual Property

The SwingBase platform, including its design, code, branding, logos, and all associated content created by Swingbase LLC, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of handicap calculations, leaderboard rankings, or any golf-related data displayed on the platform.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWINGBASE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Swingbase LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, but sections of these Terms that by their nature should survive (including Disclaimers, Limitation of Liability, and Indemnification) will continue to apply.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date" above. Your continued use of SwingBase after changes are posted constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
